ORDER

The petitioner is an accused in in C.C.No.1142 of 2025 on the file of the Additional Special court Under EC and NDPS Act, Chennai-104. The petitioner was arrested and remanded to judicial custody on 07.06.2025 for the alleged offence under Section 8(c) r/ Section 20(b) (ii) (c) and 29(1) of the Narcotic

Drugs & Psychotropic Substances Act, 1985 in Crime No. 91 of 2025 in Crime No.58 of 2026 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner along with other accused were found found in possession of 30 kgs of ganja which is a commercial quantity. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is a innocent and she has been falsely implicated in this case. He further submitted that the petitioner has been in judicial custody from 07.06.2025 and is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Counsel for Government of Tamil Nadu (CRL.SIDE) appearing for the respondent submitted that the petitioner belongs to Odisha State and he brought the contraband from Odisha to Tamilnadu and sold the same in the local area for their personal gain. He further submitted that the quantity involved in this case is commercial in nature and there are two previous cases pending against the petitioner. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. It is seen from records that the petitioner is arrayed as a second accused and the respondent has filed a final report. However, the quantity involved in this case is commercial in nature and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act, hence this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed . 11-06-2026 Index: Yes/No Speaking/Non-speaking order smn To.
