O R D E R

The present criminal original petition has been filed seeking a direction to the 3rd respondent police to register a case based on the complaint given by the petitioner dated 06.09.2015 and investigate the same in accordance with law.

2. The petitioner herein lodged a complaint as against one Senthil alleging that on 04.09.2015 at about 10.00 p.m. the said Senthil used to come often to Flat No.C, which is owned by his sister and attempted to over lock the gate. When the petitioner questioned the same, he assaulted the petitioner and abused him in filthy language. Though the said complaint has been given on 06.09.2015, the said complaint has not been registered so far. Hence, the petitioner has filed the present criminal original petition.

3. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. In view of the submissions made on either side, this Court directs the 3rd respondent police to conduct enquiry and during the course of enquiry, if no prima facie case has been made out, the 3rd respondent is at liberty to pass appropriate order on the complaint given by the petitioner.

5. This criminal original petition is disposed of accordingly.
