Respondents Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to remove the display board erected in the premises admeasuring 30,973 sq.ft. in Survey Nos.1&3 Part situated at Vazhudareddy Village, Villupuram Municipality, Villupuram Taluk and District.

Heard Mr.P.Wilson, Senior Advocate for M/s.P.Wilson Associates, learned counsel appearing for the petitioner and Mr.P.Srinivas, learned counsel appearing for the second respondent.

2. The petitioner company is a partnership firm and they have filed this Writ Petition praying the respondents to remove the display board erected in their premises. The display board states that the land in question is a park area. The petitioner would contend that there is no such acquisition done by the competent authority and in the layout promoted by the first petitioner, the said area was earmarked for construction of a Kalyana Mandapam. Therefore, it is stated the Board erected in their property is illegal and has to be forthwith removed.

3. On three earlier occasions, the case was adjourned to enable the petitioner to implead the Deputy Director of Town and Country Planning. However, today when the matter is taken up for hearing, adjournment is sought for by the learned counsel for petitioner on the same ground. Therefore, this Court is not inclined to grant any further adjournment in the matter.

4. Considering the fact that the petitioner's representation is now pending consideration by the second respondent, there will be a direction to the second respondent to consider the petitioner's representation sent through his counsel on 14.02.2014, and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
