This petition has been filed seeking to condone the delay of 140 days in representing the above C.R.P.
2. Mr.D.Arun Kumar, learned counsel for petitioner submitted that the petition was returned on 11.05.2023 for compliance of certain defects. However, due to summer vacation of the court, the returned papers could not be collected and on account of work pressure, the returned papers were mixed up with some other disposal bundles and thereafter, it was traced out only during last week. Hence he was not able to represent the petition in time. In view of the same, there is a delay of 140 days arose in representing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one.
