Respondents PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order of the 3rd respondent's proceeding No.O/Mu/A4/12 dated 09.05.2012 and quash the same as illegal, consequently direct the 1st respondent and 3rd respondent to consider the petitioner's representation dated 23.07.2012 for the sanction of the Annual increment to the petitioner in respect of the service rendered from 01.07.2006 to 30.06.2007 and pay all the revised pension and other monetary benefits within a stipulated time.

O R D E R

The relief sought for in this writ petition is to quash the order of rejection dated 09.05.2012 passed by the third respondent and to direct the respondents to consider the petitioner's representation dated 23.07.2012.

2.Though the prayer is large in nature, the learned counsel appearing for the writ petitioner made a submissions that it is suffice, if a direction is given to dispose of the representation submitted by the writ petitioner.

3.However, the Government also issued G.O.Ms.No.311 [Finance (CMPC) Department] dated 31.12.2014 and the Government order does not stipulates any cut off dates for considering such cases.

4.Thus, there is no bar in G.O.Ms.No.311 [Finance (CMPC) Department] dated 31.12.2014 to consider the case of the writ petitioner in the light of G.O.Ms.No.311 [Finance (CMPC) Department] dated 31.12.2014. 5.Therefore, the third respondent is directed to consider the representation submitted by the writ petitioner on 23.07.2012 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6.Accordingly, the writ petition stands disposed of. However, there is no order as to costs.
