Petition under Article 226 of the Constitution of India praying for issue of a Writ of Certiorari to call for the records relating to the order passed by the 2nd respondent in proceedings in Roc. No. 493/1999/(A) dated 08.02.2013 and quash the same.

O R D E R

Though the petitioner has sought quashing of the proceedings of the 2nd respondent dated 08.02.2013 on the ground that the land acquired from the petitioner was not utilised, but, today, when the matter is taken up, Mr.V.Jayaprakash Narayanan, learned Special Government Pleader submitted that the award, in respect of the petitioner's land, was passed on 30.03.2015 in Award No. 03/2014-2015 and the possession of the land was also taken over by the 2nd respondent on 21.04.2015. Moreover, there is no occasion for the petitioner to invoke the new Act since the purpose for which the petitioner's land was https://hcservices.ecourts.gov.in/hcservices/

acquired, namely, for providing house sites to Adi Dravidars, has been exempted by virtue of amendment brought in by the State Government to the new Act, in respect of land acquisition proceedings initiated for the benefit of Adi Dravidars and therefore, the provisions of the new Act will not come into play, in the case of the petitioner. Further, it is also brought to the notice of this Court that the earlier acquisition proceedings were unsuccessfully challenged by the petitioner in W.P. No. 19318 of 2013.
