Respondents Prayer :- Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to stop buses run by the respondents in Mangalampalayam Village Pirivu in Dharapuram Taluk of Tiruppur District for boarding and alighting of passengers by strictly implementing the order in Na.Ka.No.4226/A2/2006 dated 22.05.2006 passed by the respondents by considering petitioner's representation dated 05.08.2019.

ORDER

[Order of the Court was made by M.M.SUNDRESH,J.] The petitioner has come forward to file this writ petition seeking a direction to the respondents to stop the buses run by the respondent Corporation at Mangalampalayam Village Pirivu in Dharapuram Taluk, Tiruppur District, in terms of the order in Na.Ka.No.4226/A2/2006 dated 22.05.2006.

2. The learned Additional Government Pleader, on instructions, submitted that the 5th respondent has given suitable instructions to the 4th respondent in his proceedings in Na.Ka.No.15424/E1/2019 dated 16.08.2019 to stop the buses as sought for by the petitioner at Mangalampalayam Village Pirivu. The 5th respondent has further instructed the 4th respondent to take appropriate action against those Drivers and Conductors who violate the same.

3. In view of the above said submission made by the learned Additional Government Pleader, the writ petition stands allowed and consequentially, a direction is issued to the 4th respondent to see to it that the directive of the 5th respondent is implemented in letter and spirit. We make it clear that in the event of any violation, the 4th respondent shall initiate appropriate action against the erring staff, either against the driver or the conductor, or against both the driver and conductor, as the case may be. No costs. Consequently, connected WMP is closed.
