Doubting the description of the property in the sale deed of the year 1967 followed by a second sale deed of the year 2000, the criminal complaint has been filed in the year 2013 and same has been taken up for investigation. Later, on application by the defacto complainant, investigation was transferred to CCB. It is also brought to the notice of this Court that the said investigation is now been stayed.

2. The present petition is filed to implead the legal heirs of Mrs.Samanthakamani, who is the defacto complainant. It appears that the said Mrs.Samanthakamani died on 10.11.2020 and the same has not been reported to this Court and several petitions and proceedings has gone through till filing of the present petition.

3. The Learned Counsel appearing for the defacto complainant after making brief submission, sought time to place before the Court how the complaint is maintainable in spite of civil suit filed by Mrs.Samanthakamani (deceased) dismissed and First Appeal pending.

4. In the said circumstances, the petition to bring LR's of the deceased Samanthakamani/defacto complainant is allowed. 15.04.2024 bsm Note: Registry is directed to carry out necessary amendment in the cause title and post this matter on 10.06.2024.
