ORDER

This Criminal Original Petition has been filed seeking to direct the respondents 1 & 2 to not to harass the petitioners in the name of investigation on the complaint of the 3rd respondent.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) appearing for the respondent police.

3. When there is a complaint filed, it is the duty of the police to issue necessary notice for enquiry as per law and if any cognizable offence is made out, it is the duty of the police https://hcservices.ecourts.gov.in/hcservices/

to proceed as per law. It is seen that merely on the basis of civil suit is pending, the petitioners are not cooperating with the investigation. It is for the petitioners to cooperate with the investigation. Therefore, such blanket direction as sought for by the petitioners can not be granted by this Court.

4. Further, the respondent police is directed to complete the enquiry of the complaint filed against the petitioners within a period of two weeks from the date of receipt of a copy of this order.

5. Accordingly, this Criminal Original Petition stands disposed of with the above directions.
