Respondent Petition under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondent to consider and pass order on the representation dated 31.5.2017 for regularising the period of suspension in accordance with law with all service and monetary benefits.

ORDER

The writ petition has been filed seeking mandamus, directing the respondent to consider the representation, dated 31.5.2017, submitted by the petitioner for regularisation of his suspension period from 12.3.2015 till 31.3.2017.

2. The Joint Director of School Education [Personnel], Chennai,

by proceedings in R.C.No.008247/C3/S3/2015 dated 12.3.2015, placed the petitioner under suspension, as the petitioner was arrested on 12.1.2015 and kept under judicial custody in connection with a criminal case filed against him in Crime No.301 of 2005 for the offences under Sections 174(3), 147, 341, 302, 201 r/w Section 109 IPC.

The learned counsel for the petitioner contends that though the name of the petitioner was not found in the FIR, he has been falsely implicated and arrested after a period of 10 years from the date of the FIR, that too under suspicious reasons. Therefore, a direction may be issued for considering his representation. I do not find any merit in his submission, since the respondent has not completed the departmental proceedings, hence, this Court, considering the fact that the writ petition being a premature one, is not inclined to entertain this writ petition and accordingly, it is dismissed. However, there shall be no order as to costs.
