PRATHAP KUMAR, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J) This criminal miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner by judgment dated 14.08.2020 in Spl.C.C.No.47 of 2019 on the file of the Sessions Court, (Special Court for Exclusive Trial under the Prevention of Children from Sexual Offences Act, 2012), Coimbatore and to enlarge the petitioner on bail till the disposal of the appeal. 2.
It is the case of the prosecution that the petitioner, who was aged about nineteen years, had ravished his own cousin sister, who was aged about thirteen years, and on account of which, she conceived. Though the victim girl turned hostile, the prosecution was able to establish the crime via DNA Profiling. 3.
Taking into consideration the serious nature of the case, this is not a fit case to grant suspension of sentence and bail. https://hcservices.ecourts.gov.in/hcservices/
Hence, this criminal miscellaneous petition is dismissed.
