By consent, the writ petition is taken up for final disposal.
The petitioner claims to be Temple Committee Member of Sri Kaliyamman and Gangaiyamman Temple at Agaram Colony, Tholapalli Post, Madhanoor Via, Ambur Taluk, Vellore District. He submitted a representation/application dated 03.06.2016 to the respondent, seeking permission to conduct a cultural program on 08.06.2016, in connection with the temple festival, which includes song and dance programme and since, he has not been favoured with any kind of response, came forward to file this writ petition.
Heard the learned counsel for the petitioner and Mr.R.A.S.Senthilvel, learned Additional Government Pleader who accepts notice on behalf of the respondent and who would submit https://hcservices.ecourts.gov.in/hcservices/
that since the petitioner has approached this Court at the very last minute, orders cannot be passed on the representation/application submitted by him and that too, no acknowledgment has been produced for having submitted such representation/application.
This Court considered the rival submissions.
As rightly contended by the learned Government Advocate, the petitioner has approached this Court at the very last moment and therefore, this Court is not in a position to pass any positive orders in respect of the function to be held on 08.06.2016. However, taking into consideration, the facts and circumstances, this Court permits the petitioner to submit one more representation/application to the respondent to conduct the cultural programme in connection with the temple festival to be held on future date and the respondent, on receipt of the same, is directed to consider the said representation / application in accordance with law within a period of one week from the date of receipt of such representation/application and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
