Respondents Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorafied Mandamus to quash the order of the second respondent in letter No.PPO/449/CLRI/94(343) dated 30.06.2021 (signed on 01/07/2021) and consequently direct the second respondent herein to release Family Pension to the petitioner herein without any deduction within a time frame.

2. Learned counsel appearing for the respondents 1 and 2 has also raised a preliminary objection as to the maintainability of the writ petition on the ground that the Central Leather Research Institute, is notified as an establishment covered by the Central Administrative Tribunal Act. However, he has no serious objection to permit the petitioner to withdrawn this writ petition with liberty to the petitioner to approach the Central Administrative Tribunal or any other forum.

3. Having regard to the above circumstances, this writ petition is dismissed as withdrawn with liberty to the petitioner to approach appropriate forum if circumstances warrant. No costs. Consequently, connected miscellaneous petition is closed.
