The petitioners, who were arrested and remanded to judicial custody on 24.03.2023, for the offences punishable under Sections 341 & 394 IPC and subsequently altered to 341, 395 r/w 397, 109 and 120(B) of IPC, in Crime No.182 of 2023, seek bail.
2.There are totally five accused involved in this case and the petitioners are arrayed as A2 to A5. The case of the prosecution is that on 20.03.2023 at about 10.30 a.m., the petitioners along with other accused waylaid the defacto complainant and snatched 1 1⁄2 kgs of gold jewels and a sum of Rs.1,00,000/- from the defacto complainant and threatened with dire consequences. Thereafter, they escaped from the scene of occurrence. Hence, the complaint.
3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and due to previous enmity, a false case has been foisted against these petitioners. He would submit that the petitioners were arrested on 24.03.2023 and they have been in judicial custody for more than 40 days. gbi 4.The learned Additional Public Prosecutor would submit that the petitioners are habitual offender. On 20.03.2023 at about 10.30 a.m., the petitioners along with other accused waylaid the defacto complainant and snatched 1 1⁄2 kgs of gold jewels and a sum of Rs.1,00,000/- from the defacto complainant and threatened with dire consequences. He would further submit the respondent police recovered one sovereign of gold jewels from these petitioners and no money was recovered from these petitioners. He would further submit that A2 is having one previous case pending against him and there is no previous case pending against other petitioners.
