PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus forbearing Respondent Nos.1 and 2 from constructing or permitting any permanent structure in OSR-lands measuring an extent of 1214.53 sq.m in T.S.Nos.113/3, 113/4 and 113/5 and B.No.65 Padikuppam Road, Chennai, Respondent No.3 from granting or regularizing any approval, and Respondent No.4 from supporting or advocating construction in the OSR land of Pace Prana Apartments, and to direct all Respondents to maintain the land strictly as open space.

ORDER

By consent of both the learned counsel appearing for the petitioners as well as respondents, this writ petition is disposed of at the admission stage itself.

2. The Writ Petition has been filed to issue Writ of Mandamus, forbearing the respondents 1 and 2 from constructing or permitting any permanent structure in OSR Lands measuring an extent of 1214.53 sq.m in T.S.Nos.113/3, 113/4 and 113/5 and B.No.65 Padikuppam Road, Chennai.

3. Mr.E.C.Ramesh, learned Standing Counsel (GCC) takes notice for the respondents 1 and 2 and Mr.B.Sanjay Balachandar, learned Standing Counsel (CMDA) takes notice for the 3rd respondent.

4. When the writ petition is taken up for hearing, learned Standing Counsel appearing for the respondents would submit that the respondents have not given any permission for construction of permanent structure in OSR Lands. The said submission made by the learned Standing Counsel appearing for the respondents is recorded.
