W.M.P. No. 16226 of 2021 in W.P. SR No. 58885 of 2021 (through video conference) P.D.AUDIKESAVALU, J., and B.PUGALENDHI, J., [Order of the Court was made by P.D.AUDIKESAVALU, J.,] The Writ Petition challenges the list of provisionally selected candidates to the posts of Typist and Computer Operator by direct recruitment published on 22.04.2021 by the Second Respondent and for consequential directions. 2.

This application has been made under Rule 2A-Appendix III of the Madras High Court Appellate Side Rules to regulate proceedings under Article 226 of the Constitution to permit the Petitioners to array the Third and Fourth Respondents in representative capacity by describing them as those who have been affected in the event of any relief granted to the Petitioners in the Writ Petition.

As the selected candidates would be prejudicially affected in the event of granting any relief to the Petitioners in the Writ Petition, they are undoubtedly necessary parties for effectual and complete adjudication of the matter. Even before passing of the impugned order in this Writ Petition, certain other

candidates have filed Writ Petitions in W.P. (MD)Nos. 7544, 7753 and 10465 of 2021, relating to the same issue and this Court by order dated 01.04.2021 in W.P. (MD) No.7544 of 2021 passed the following order:- "Any appointment made is subject to the result of the Writ Petition"

In such circumstances, the publication of notice shall be made under the proviso to Rule 2A-Appendix III of the Madras High Court Appellate Side Rules to regulate proceedings under Article 226 of the Constitution. The Registry shall also issue certified copies of the records of the Writ Petitions to the selected candidates, if such applications are made, on payment of prescribed charges. The First and Second Respondents shall inform all the selected candidates in the impugned list regarding the pendency of the Writ Petitions in W.P. (MD) Nos. 7753, 7544 and 10465 of 2021 and this Writ Petition and that these matters will be heard on 27.08.2021 under written acknowledgement and file proof of the same.

Mr. R.Shanmugasundaram, Learned Advocate General, appearing for the First and Second Respondents informs that Counter-Affidavit in this Writ Petition would be filed by 13.08.2021, after furnishing copy to the Learned Counsel for the Petitioner.

Mr. N.G.R.Prasad, Learned Counsel appearing on behalf of the Petitioner in all these cases states that if the selected candidates seek copies of the writ petition and typed-set, the same would be furnished to them at free of cost, immediately. The said statement is placed on record. 6.
