PERIYANNAN ... Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the first respondent to conclude the inquiry and to pass final orders in proceedings No.Oo.Se. Po/ e.Pa/Ki/Pennagaram/Co.Court Case/ No.114/ 2023, dated, 14.08.2023, within a time frame as may be fixed by this Court.
For Petitioner : Mr.A.Bharani Chandar 1/5
For R1 & R2 : M/s.Swami Subramanian (TANGEDCO)
ORDER
This writ petition is filed for a direction to the first respondent to conclude the enquiry and to pass final orders with reference to the proceedings dated 14.08.2023.
2. Upon hearing the learned counsel appearing for the petitioner and perusing the affidavit filed in support of the writ petition, it can be seen that for the very same grievance, the petitioner earlier approached this Court by W.P. No. 20232 of 2023 and by an order dated 10.07.2023, this Court directed the first respondent to hold an enquiry on the complaint/representation of the petitioner dated 08.04.2023 within a period of four weeks from the date of the order by giving opportunity to all concerned. Thereafter, the first respondent held an enquiry on 14.08.2023 and the enquiry report was also forwarded. Thereafter, it seems that no final orders have been passed.
3. In respect thereof, the petitioner should have been well advised to file a contempt petition, this second writ petition itself is unnecessary. In any event, when the matter came up for admission, Mr. Swami Subramanian takes 2/5
notice on behalf of the first and second respondents.
4. In view of the fact that this Court has already ordered the enquiry, it is but natural that the respondents should pass final orders in respect of the matter.
5. In view thereof, this writ petition is ordered on the following terms:- (i) The first respondent is directed to pass final orders based on the enquiry report within a period of two weeks from the date of receipt of the web copy of this order, without waiting for the certified copy. (ii) The first respondent shall always consider the spirit of the order whenever any direction of this Court is issued and shall comply with the order. No costs.
