O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to disburse the belated payment of interest amount of provident fund, gratuity and earned leave surrender amounts and other unsettled benefits Arrears of leave surrender while in service, 12(3) wage settlement and DA arrears with effect from 01.07.2022.

2. The case of the petitioner is that she joined in the 1st respondent Corporation on 12.09.1990 and had retired from her service on 30.06.2022. It is the grievance of the petitioner that she is entitled for retiral benefits like provident fund, gratuity and earned leave surrender amounts and other unsettled benefits arrears of leave surrender, 12(3) wage settlement and DA arrears with effect from 01.07.2022 were paid belatedly. Hence, she made a representation dated 05.03.2025 requesting the respondents to pay interest for the belated payment of terminal benefits. 2/6

The learned Standing Counsel for the respondents would fairly admits that in view of the similar orders passed by this Court in W.P.Nos. 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay the eligible and admissible amount with interest at the rate of 6% per annum for the belated payment of terminal benefits, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order. 3/6

6. In the result, this Writ Petition is disposed of with the above observations. No costs.
