2. Heard the learned advocate for the petitioner/ appellant and the learned Additional Public Prosecutor for the respondent.

3. Having heard the learned advocates for the respective parties and having considered the material on record, this Court finds that the delay is properly explained. Delay is condoned and this petition is allowed.
