PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd to 4th respondents to survey the petitioner's land comprised in Survey No.6/8A measuring 24.50 Ares as per Patta No.580 situated at Pazhaveri Village, Vandhavasi Taluk, Thiruvannamalai District, and to identify and segregate the same by placing the Boundary Stones, at the cost and expenses of the petitioner. ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of mandamus, directing the 2nd to 4th respondents to survey the petitioner's land comprised in Survey No.6/8A measuring 24.50 Ares as per Patta No.580 situated at Pazhaveri Village, Vandhavasi Taluk, Thiruvannamalai District and to identify and segregate the same by placing boundary stones.
3. It is submitted by the learned counsel for the petitioner that the petitioner had submitted representations before the 4th and 1st respondent on 2/5
24.06.2024, 02.09.2024 respectively, to survey and place boundary stones at the petitioner's land comprised in Survey No.6/8A, measuring 24.50 Ares, as per Patta No.580 and has also paid necessary fees as early as on 20.02.2024. Further, the petitioner had submitted a representation before the Hon'ble Chief Minister Grievance Cell on 09.09.2024. However, the petitioner's representations were not considered by the respondent till date, thus the present writ petition has been filed before this Court.
4. On this being pointed out, the learned Special Government Pleader would submit that they would consider the petitioner's representation and carry out a survey of the subject property within a time frame fixed by this Court, which was agreed to by the learned counsel for the petitioner.
5. In view thereof, the writ petition stands disposed of with the direction to the respondents to carry out a survey and complete the survey and submit a report within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice to the petitioner, adjacent land owners and other interested parties including rival claimants if any. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance 3/5
with law. No costs.
