ORDER

This writ petition has been filed for issue of writ of mandamus directing the 2nd and 3rd respondents to implement the order passed by the 1st respondent through proceedings dated 11.11.2020, wherein, the petitioner is seeking for the repayment of excess loan amount along with interest. 2.Heard Mr.P.Ganapathy, learned counsel appearing on behalf of the petitioner and Mr.E.Veda Bagathsingh, learned Special Government Pleader appearing on behalf of the respondents.

3/6 3.The petitioner availed the housing loan for construction of house. He gave security by means of deposit of title deeds. The mortgage was redeemed through proceedings of the 1st respondent dated 17.06.2019. According to the petitioner, he paid excess principal amount of Rs.12,000/- and interest of Rs.25,057/- and in total a sum of Rs.37,057/-. The loan amount came to be deducted from his monthly salary. In view of the same, he made a representation to the 1st respondent and the 1st respondent through proceedings dated 11.11.2020, directed the 2nd respondent to refund the excess principal and interest amount paid by the petitioner. Even though the petitioner approached the 2nd and 3rd respondents in this regard, the same did not evoke any response and it is under these circumstances, the present writ petition has been filed before this Court.

4.Taking into consideration the facts and circumstances of the case and considering the proceedings of the 1st respondent dated 11.11.2020, there shall be a direction to the 2nd respondent to act upon the order passed by the 1st respondent and to release the excess loan amount which covers both the

4/6 principal and the interest, within a period of four weeks from the date of receipt of copy of this order.
