ORDER
This writ petition is filed for a direction to the respondents to issue patta to the petitioners property to the extent of 1172 square feet situated in Old Survey No.149/2 New survey No.846/10 at Kurichy Village, Madukkarai Taluk, Coimbatore District in pursuance to the recommendation made by the first respondent in Mu.Mu.315/2019/Aa3 dated 11.07.2019 and the recommendations of the second respondent in Na.Ka. No.3091/2018/A1 dated 18.01.2019 and Na.Ka.2297/2021/A4 dated 05.07.2022.
2. It is the case of the petitioner despite the recommendation of the second respondent to issue patta, patta has not been issued to the petitioner. Hence, this writ petition.
3. Heard both sides and perused the materials available on record.
4. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
5. The proceedings of the Tahsildar/second respondent dated 05.07.2022 indicate that the Tahsildar has sent a report to the first respondent/RDO 2/4
indicating no objection for issuing the patta. Such view of the matter, this Court is of the view that it is for the first respondent to take a decision on the basis of relevant rules governing the field in issuing patta.
6. Accordingly, the first respondent is directed to consider the report of the second respondent and pass appropriate orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of this Order.
