ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(c) and 20 (b)(ii)(B) of Narcotic Drugs and Psythotropic Substance Act, 1985 in Crime No.1360 of 2020, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused were in possession of 1kg and 300 grams of Ganja and the respondent police seized the contraband and registered a case against the petitioner and other accused.
3.The learned counsel appearing for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate vehemently opposed for grant of anticipatory bail by stating that the petitioner along with other accused were in possession of 1kg and 300 grams of Ganja. He further submits that the petitioner has three previous cases similar in nature.
5. Considering the facts of the case and the quantity of contra band involved is very high and the petitioner has three previous cases to his credit, this Court is not inclined to grant https://hcservices.ecourts.gov.in/hcservices/
anticipatory bail to the petitioner. Accordingly this Criminal Original petition is dismissed.
