Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 3rd respondent to give police protection to the petitioner and her children based on the petitioner's representation dated 06.07.2021. For Petitioner :

ORDER

This Criminal Original Petition is filed seeking a direction, to direct 3rd respondent to give police protection to the petitioner and her children.

2. According to the petitioner, there is a civil dispute between the petitioner's husband and his brothers. Due to which, on 30.06.2021, One Rajamanickam, who is the brother of the petitioner's husband and others came to the house of the petitioner and attacked her and also threatened her with dire consequence. Hence, the petitioner gave a complaint on 30.06.2021, followed by a representation dated 06.07.2021 to the respondent police. Since the said Rajamanickam and others are influential persons, there was life threat to the petitioner and her family members. Hence, the present petition.

3. The learned Government Advocate(Crl. side) appearing for the respondents would submit on the complaint of the petitioner, a case has been registered in Crime No.435 of 2021 for the offences under sections 294(b), 323 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, as against 4 accused persons, namely, Rajamanickam, Dhanabal, Malarkodi, Rokini. In view of the same, nothing survives in this petition.

4. I have considered the submissions made on either side and perused the materials available on records carefully.

5. Considering the fact that the petitioner is a lady residing alone with her two daughters and a minor son and her husband is working abroad, the third respondent police is directed to give proper protection to the petitioner and their children.

6. With the above direction, this Criminal Original Petition is disposed of.
