Respondent Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondent to accept the online registration / application of the petitioner and permit him to participate in the selection process pursuant to the employment notification in Advt.No.05/2015 dated 05.08.2015 for selection to the post of Manager / Legal (E4). By consent, the writ petition is taken up for final disposal.

2. Heard the submissions of the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondent.

3. The learned standing counsel appearing for the respondent would submit that in respect of the representation dated 17.08.2015, submitted by the petitioner, response has been sent on 18.08.2015, stating among other things that two vacancies which have been notified for the post of Manager (Legal) are unreserved (UR) vacancies and as per the Government of India guidelines, no relaxation in qualifying criteria, including relaxation in upper age limit, could be extended for considering against the unreserved vacancies and therefore the claim of the petitioner was not considered.

4. The learned counsel appearing for the petitioner, on instructions, seeks liberty to work out his remedy in accordance with law.

5. In the light of the said communication sent by the respondent / Neyveli Lignite Corporation Limited dated 18.08.2015, the writ petition is dismissed, however, if the petitioner is, so advised and if it is available in law, the petitioner is at liberty to workout his remedy. No costs.
