..Respondent(s) PRAYER : Civil Revision Petition is filed under Article 227 of the Constitution of India, to set aside the order passed by the Principle Judge, Family Court, Chennai in returning the petition in IA.SR.No.2144 of 2026 filed by the petitioner under Section 151 of the code of Civil procedure and to direct the learned Principle Judge, Family Court, Chennai, to number the petition in IA.SR. No.2144 of 2026 in IA.No.5 of 2025 in OP.No.1839 of 2024.

ORDER

Before the trial court, the respondent / husband filed IA to give the copy of the twelve documents relied by the respondent / wife in interim application in IA No.5 of 2025. The twelve documents were already filed along with the affidavit filed by the respondent / wife. The revision petitioner, being the husband, wants to produce those documents therefore he wants to peruse those documents before submitting his submission. Therefore, he filed the copy application before the trial court and the same was returned by the trial judge stating that the unmarked documents cannot be complied. Therefore, he filed an application in IA Sr. No.2144 of 2026 under Section 151 CPC sought for serving the true copy of twelve documents referred to and relied upon in the interim maintenance petition in IA No.5 of 2025 in OP No.

1839 of 2025 along with the bank statement and affidavit of assets and liabilities to the petitioner and to grant a reasonable time to the petitioner to file his counter to the interim maintenance petition upon receipt of twelve documents along with the bank statement and affidavit of assets and liabilities. So far the trial judge has not taken on file the said application and therefore sought for direction to take such Interim Application.

2. The learned counsel for the respondent submits that in order to prove her claim, she filed twelve documents along with affidavit. As on date, she produced documents before the trial court and before filing objections, the revision petitioner / husband wants to peruse those documents which is sustainable in law. Therefore, the trial judge is directed to take the Interim Application and dispose of the IA within two weeks from the date of receipt of a copy of this order. After disposal of this IA, the trial court can proceed with IA No.5 of 2025.

3. With the above direction, this Civil Revision Petition stands disposed of. No costs. Consequently, connected Civil Miscellaneous Petition is closed. 10-04-2026 Index: Yes/No Speaking/Non-speaking order MTL To
