This Civil Miscellaneous Petition has been filed seeking to condone the delay of 639 days in filing the above Civil Miscellaneous Appeal against the award dated 09.02.2023 passed in M.C.O.P.No. 1863 of 2013, on the file of Motor Accident Claims Tribunal, Chief Judicial Magistrate, Cuddalore.

2. Mr.S.S.Santhosakumar, learned counsel for appellant submitted that only after getting approval from the competent authorities, the appeal has to be filed, however, due to non-availability of official, the appellant is not able to prefer appeal within a stipulated time and thereafter after getting necessary approval, the appeal was filed on 14.03.2025, as a result of which, there is a delay of 639 days in filing the above Civil Miscellaneous Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Civil Miscellaneous Appeal.

3. Though the name of respondent printed in the cause list, there is no representation on their behalf.

4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
