PRAYER: Criminal Original Petition is filed under Section 439 (1)(b) of Cr.P.C. praying to modify the condition imposed by this Court in Crl.M.P.No.853 of 2024 dated 18.04.2024 on the file of Principal Sessions Judge, Chengalpattu.

ORDER

This Criminal Original Petition has been filed to modify the condition imposed by this Court in Crl.M.P.No.853 of 2024 dated 18.04.2024 on the file of Principal Sessions Judge, Chengalpattu.

2. Learned counsel for the petitioner submitted that the petitioner was granted bail by the learned Principal Sessions Judge, Chengalpattu in Crl.M.P.No.853 of 2024 on 18.04.2024 with a condition that "the petitioner is ordered to be released on bail on his execution of bond for a sum of Rs.10,000/- with two sureties each (Out of which, one Surety should be blood relatives) for a like sum to the satisfaction of the District Munsif cum Judicial Magistrate, Sholinganallur". He further submitted that, he is originally from Nepal and therefore, he is not able to provide blood surety. Thus, he seeks modification of blood surety to normal surety to the satisfaction of the District Munsif cum Judicial Magistrate, Sholinganallur.

Government Advocate (Crl.Side) for the respondent.

4. In view of the above submission, the condition imposed by the learned Principal Sessions Judge, Chengalpattu in Crl.M.P.No.853 of 2024 on 18.04.2024, is modified as follows and the other conditions remains unaltered.

" The petitioner is ordered to be released on bail on his execution of bond for a sum of Rs.10,000/- with two sureties each ( Out of which, one surety should be anyone of his relatives) for a like sum to the satisfaction of the District Munsif cum Judicial Magistrate, Sholinganallur".
