ORDER

1. Heard.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of F.C.O.P.No.60 of 2025 pending on the file of the Family Court, Vellore, and transfer of the same to the file of the Family Court, Chennai.

3. The marriage between the petitioner and the respondent was solemnized on 31.08.2020 at Sri Subramaniaswamy Tirukoil, Thirumalaikodi, Ariyur, Vellore. The respondent filed FCOP No.60 of 2025 before the Family Court, Vellore seeking divorce.

4. The petitioner is the wife. She states that she is residing at Ayanavaram, Chennai. The Original Petition in F.C.O.P.No.60 of 2025 has been filed by the respondent/husband seeking divorce.

5. The respondent has entered appearance and has vehemently opposed the transfer, denying the averments/allegations made by the petitioner in paragraphs 4, 7 and 8 of the affidavit filed in support of the transfer petition.

6. Be that as it may, the question in a transfer petition is one of forum convenience for effective participation in the proceedings. Having regard to the residence of the petitioner at Chennai and the attendant travel hardship pleaded by her, this Court is satisfied that the transfer sought deserves to be ordered.

7. Accordingly, Tr.C.M.P.No.425 of 2025 is allowed. F.C.O.P.No.60 of 2025 on the file of the Family Court, Vellore is withdrawn and transferred to the file of the Family Court, Chennai. The Family Court, Vellore shall transmit the entire records to the Family Court, Chennai, within three weeks from the date of receipt of a copy of this order and and the Family Court, Chennai shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 24.04.2025 shall stand vacated and consequently, connected CMP No.9891 of 2025 is closed.
