Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the first respondent to Transfer the investigation in Crime No 63 of 2024 on the file of the Deputy Superintendent of Police Vaniyambadi to CBCID Wing, Thirpathur.

O R D E R

This Criminal Original Petition has been filed seeking transfer of investigation in Crime No.63 of 2024 from the file of the second respondent to any other investigating agency.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Pursuant to the demise of the petitioner's daughter, the second respondent registered an FIR in Crime No.63 of 2024 for the offence under Section 174 of Cr.P.C. However, there are specific allegations to attract the offences under Sections 498-A and 306 of IPC as against the accused persons. Despite the same, the second respondent has not altered the provisions of law so far.

4. On instructions, the learned Government Advocate (Crl.Side) appearing for the respondents submitted that the petitioner's daughter, who got married on 21.08.2023, committed suicide by hanging

herself in her matrimonial house. Subsequently, her husband also committed suicide. It is further submitted an enquiry by the Revenue Divisional Officer is now pending.

5. In view of the above, the second respondent is directed to proceed based on the Revenue Divisional Officer's report, complete the investigation and file a final report within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition stands disposed of.
