ORDER
By consent of counsels to both the parties, this writ petition is disposed of today at the admission stage itself.
2. This Writ petition has been filed seeking to issue a Writ of Mandamus directing the first and second respondents to consider the representation dated 21.05.2022 of the petitioner and to pass orders.
3. The case of the petitioner in brief.
The petitioner's husband and her school going children are
residing at Thirunelveli in her in-law's house and she is working as a Staff Nurse. Earlier, by order of this court dated 09.03.2018 in W.P.5280/2018, she was transferred from Thiruvarur Government Hospital to Thirunelveli Government Hospital vide deputation order dated 23.07.2018. Now the deputation order was cancelled on 13.05.2022 and she was asked to join duty at Thiruvarur Government Hospital. The petitioner obeyed the order and joined duty on 19.05.2022. There is no reason to cancel the earlier deputation order, since there are four vacancy is existing at Thirunelveli Hospital. Therefore, the petitioner has made a representation dated 21.05.2022, requesting to transfer her to Thirunelveli Govt. Hospital. But it was not considered. Hence this writ petition.
4.The learned Government Advocate appearing for the respondents submitted that the representation of the petitioner would be considered by the second respondent and appropriate orders would be passed in accordance with law as well as guidelines.
5. In view of the above submissions and also considering the limited scope of prayer, without expressing any opinion on merits, this court is inclined to pass the following order. i) The second respondent is directed to consider the representation of the petitioner dated 21.05.2022 and to pass appropriate orders on its own merits and in accordance with law, as early as possible, within a period of eight weeks from the date of receipt of a copy of this order.
ii) It is needless to say that the petitioner shall furnish the copy of this order along with the representation before the second respondent, within a period of one week from the date of receipt of a copy of this order.
6. With the above directions, the writ petition is disposed of at the admission stage itself. No costs.
