Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to survey the lands comprised in Survey Nos.181/4, 181/5, 181/6, 181/8, 206/6A, 206/6B, 206/6C, 206/7B, 206/7C, 206/7D of an extent of 2 acres and 50 cents in Kattur Village, Ponneri Taluk, Thiruvallur District with the help of competent surveyor in field measurements, village map and further direct the respondents to mark the land laying corner stones and to file a report within a stipulated period, thereby directing the respondents to dispose of petitioner representation dated 29.08.2017 within a fixed time frame.

Mr.P.Senthilvel, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner seeks for a Mandamus directing the respondents to survey the lands comprised in Survey Nos.181/4, 181/5, 181/6, 181/8, 206/6A, 206/6B, 206/6C, 206/7B, 206/7C, 206/7D of an extent of 2 acres and 50 cents in Kattur Village, Ponneri Taluk, Thiruvallur District and mark the land laying corner stones, based on his representation dated 29.08.2017.
4. The grievance of the petitioner before this Court, is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the respondents to consider and decide the same on merits and in accordance with law. Accordingly, the writ petition is disposed of, only by directing the respondents to consider the representation of the petitioner dated 29.08.2017 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the respondents within a period of eight weeks from the date of receipt of a copy of this order. No costs.
