.. Defendants This Civil Suit is filed under Order VII, Rule 1 of CPC r/w 2/6

Order IV Rule 1 of O.S, prayed to pass a Judgment and Decree, against the defendants, a).Directing the defendants 1-6 to specifically perform the obligations and duties enjoined upon them being the legal heirs and intermeddlers of the estate of Late Dr.J.Jeppiaar and to transfer the shares 2,55,000 in favour of the 2nd and 3rd plaintiffs on a day to be fixed by this Court and to perform such incidental acts, deeds things which are essential for the implementation of the MOU dated 18.11.2014 entered into between Dr.J.Jeppiaar and Remibai Jeppiaar with plaintiffs 2 and 3 as renewed on 09.02.2015 and 30.10.2017;

b).Mandatory injunction directing the defendants 1-6 to discharge the liabilities, debts payable in respect of the 1st plaintiff or purported guarantee or securities purported to have been offered by J.Jeppiaar in respect of the companies promoted by him by liquidating the securities or assets of Late J.Jeppiaar Estate. c).Mandatory injunction directing the 2nd defendant to withdraw all pending proceedings initiated as against the plaintiffs in the light of the compromise reached in C.S.No.256 of 2018 dated 09.07.2018 between defendants 1-8.

d).For a declaration that the 9th defendant is not entitled to 3/6

proceed as against the 1st plaintiff or its present directors, namely, plaintiffs 2 and 3 on the basis of purported corporate guarantees in the light of the decrees passed in C.S.No.256 of 2018 dated 09.07.2018. e).For granting such further or other relief; f).For the costs of the suit.

JUDGMENT

Heard learned counsel for the plaintiffs.

2.There is no representation for the defendants. 3.The learned counsel for the plaintiffs submitted that the matter has been settled out of the Court between the parties and a memo had been filed to that effect along with the copy of the settlement agreement entered into between the parties.

4.In view of the above, the suit is dismissed as settled out of the Court. No costs. The Registry may refund the Court fee in accordance with the Rules.
