PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to ensure that there is no hindrance from the fourth respondent in conducting the Annual Chitirai festival at Arulmigu Shri Mahasakthi Mariamman temple at Kongal Nagaram, Udumalaipet, Tiruppur scheduled to commence from 14.05.2024 to 31.05.2024 and further to direct the fifth respondent police to provide police protection for the peaceful conduct of the festival.

This Writ Petition has been filed to issue a Writ of Mandamus, directing the second respondent to ensure that there is no hindrance from the fourth respondent in conducting the Annual Chitirai festival at Arulmigu Shri Mahasakthi Mariamman temple at Kongal Nagaram, Udumalaipet, Tiruppur scheduled to be commenced from 14.05.2024 to 31.05.2024 and further to direct the fifth respondent police to provide police protection for the peaceful conduct of the festival.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the fifth respondent and perused the materials available on record.
3. Having regard to the submissions made by the learned counsel on either side and taking into consideration the limited prayer sought for by the writ petitioner in this Writ Petition and also considering the fact that the festival is to be conducted on 14.05.2024 to 31.05.2024, the fifth respondent is directed to consider the petitioner's representation dated 24.04.2024, after affording opportunity of hearing to the fourth respondent herein on or before 13.05.2024 and pass appropriate orders on merits and in accordance with law.
4. With the abovesaid direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
