O R D E R

The Office of the Accountant General (A and E), Tamil Nadu, Chennai - 600 018 is suo motu impleaded as 4th respondent.

2. This writ petition has been filed for issue of writ of mandamus directing the 2nd respondent to issue identity certificate by identifying the petitioner as S.Chellammal instead of N.Chellammal.

3. Heard Mr.R.Ramesh, learned counsel appearing on behalf of the petitioner and Mr.G.Velu, Additional Government Pleader appearing on behalf of the respondents.

4. The case of the petitioner is that her husband was a Government servant and he was working as a Record Clerk in a Government Higher Secondary School. After his retirement, he was receiving pension and in the pension papers, the petitioner's husband has mentioned the name of the petitioner as N.Chellammal. The petitioner's husband died on 06.04.2008. The petitioner applied for family pension in the year 2020 and on considering the same, the impleaded 4th respondent ordered for payment of family pension, which was received by the petitioner from July, 2021 onwards.

5. The petitioner was insisting for the arrears of family pension from 2008 to 2021. However, the pension authorities seem to have insisted for getting an identity certificate from the 2nd respondent to the effect that the correct name of the petitioner is S.Chellammal. This, in view of the fact that the initial of the petitioner has been mentioned in the pension papers as N.Chellammal instead of S.Chellammal. The representation made by the petitioner to the 2nd respondent in this regard did not evoke any response and consequently, the present writ petition has been filed before this Court. 3/6

In the considered view of this Court, if the petitioner has been identified to be the wife Selvamuthu and ultimately, family pension has been paid to the petitioner from the year 2021, it is bizarre as to why the authorities are insisting for identity certificate for the period from 2008 to 2021. The petitioner could not have been some other person during the said period. In the name of following procedure, the authorities have taken the case to some ridiculous levels. In any case, the petitioner is suffering without getting the arrears of family pension from 07.04.2008 to June, 2021. Therefore, to complete the formalities, this Court deems it appropriate to direct the 2nd respondent to issue such a certificate to the petitioner.

In the light of the above discussion, there shall be a direction to the 2nd respondent to issue an identity certificate to the petitioner by intimating that the actual initial of the petitioner is "S" and there is no discrepancy in the identity of the person. This process shall be completed by the 2nd respondent within a period of four (4) weeks from the date of receipt of a copy of this order. On receipt of the identity certificate, the pension authorities shall act upon the same.

8. This writ petition is disposed of with the above directions. No costs.
