Mr.V.Ravi for R1 R2 - Not ready in notice No appearance for R3 & R4 J UD G M E N T The defendants 1, 2 & 5are the appellants in this appeal. In respect of suit 'B' schedule property, the first respondent herein filed a suit in O.S.No.6654 of 2008 on the file of XVII Assistant City Civil Court, Chennai. By judgment and decree dated 03.10.2013, the suit came to be dismissed. The first respondent had filed appeal in A.S.No.222 of 2014 on the file of III Additional City Civil Court, Chennai. By judgment and decree dated 28.04.2015, the appeal was allowed and the suit was decreed. Aggrieved over the same, the appellants are before this Court.
2. During the pendency of the appeal, the parties resolved the dispute and entered into a compromise and recorded the joint memo of compromise dated 31.01.2025. All the appellants have signed in the 2/5
memo along with the counsel and the first respondent, who is the contesting party / plaintiff in the suit has also signed in the memo along with the counsel.
3. In view of the compromise entered into between the parties, the Second Appeal stands disposed of in terms of the compromise memo dated 31.01.2025. The compromise memo shall form part of the decree. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
