This petition has been filed to condone the delay of 74 days in filing the above Second Appeal.

2. It is represented by the learned counsel for the petitioner that the notice sent to the third respondent has been returned as R3 died. It is further stated that the third respondent is the son of the petitioner and the husband of the first respondent and father of the second respondent and there is no other legal heirs.

3. In the light of the above submission and also considering the averments stated in the affidavit filed in support of the petition, the delay is condoned. Accordingly, this petition is ordered.
