Application No.2389 of 2021 in C.S.DR.No.53960 of 2021 V.PARTHIBAN,J.

Seeking leave to file suit against the second and third defendants in respect of the properties; in item Nos.1, 2, 3, 4, 6, 7, 8, 9, 10, 11, 14 and 15 of the Schedule, which lies outside the jurisdiction of this Court, the applicants/plaintiffs have come up with this application.

2. The suit is filed for partition and separate possession.

3. Learned counsel for the applicants submitted that several items of suit properties situate within the jurisdiction of this Court and Item Nos.1, 2, 3, 4, 6, 7, 8, 9, 10, 11, 14 and 15 of the Schedule alone situate outside the jurisdiction. To avoid multiplicity of proceedings, leave is necessary to file single suit in respect of all the items of suit properties, the learned counsel contended.

4. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
