ORDER
Alleging that the order of this Court dated 06.10.2025 passed in W.P.No.17675 of 2023 has not been complied with, the present contempt petition has been filed.

The petitioner preferred W.P.No.17675 of 2023 seeking the following prayer:
"to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order issued by the 4th respondent in Athi.Mu.No.0981/A1/2023, dated 19.05.2023 and to quash the same and consequently directing the respondents therein to sanction selection grade to the petitioner in the post of Headmaster in the 5th respondent school, in consideration of 10 years completed service in the post of Headmaster from 01.06.2012 to 31.05.2022, with consequential retirement benefits and pensionary benefits, within a time frame to be fixed by the Court"

When the writ petition came up for hearing on 06.10.2025, this Court, after hearing either side and after considering the materials available on record, disposed of the writ petition by setting aside the order impugned therein and further, directing the respondent to sanction selection grade to the petitioner in the post of Headmaster in the fifth respondent school therein, in consideration of ten years of service rendered in the post of Headmaster from 01.06.2012 to 31.05.2022, with consequential retirement and pensionary benefits, within a period of eight weeks from the date of receipt of a copy of the order. 4.
Alleging non-compliance of the aforesaid order, the present contempt petition has been filed.

When the matter was taken up today, the learned Additional Advocate General - II assisted by the learned counsel appearing for the respondents submitted that the order of this Court dated 06.10.2025 passed in W.P.No.17675 of 2023 has been duly complied with. Though there had been certain delay on the part of the respondents in complying with the order of this Court, the same was on account of administrative reasons and the same is neither wilful nor wanton and therefore, the respondents may be absolved of the charge of contempt.

Heard the learned counsel on either side and perused the materials on record.

From the records, it is seen that the order of this Court has been complied with. Though there had been a delay in complying with the order of this Court, since the same was on account of administrative reasons, the delay is condoned.
Recording the compliance, though belated, this contempt petition is closed.
