SUBRAMANIAM CMP No.18529 of 2019 IN AS.608 of 2019 KRISHNAN [ PETITIONER ] Vs DHANRAJ [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay the Decree and Judgement dt. 11/01/2019 by III rd Additional District Judge, Kallakurichi in OS NO. 16/2017 including the execution proceedings (CMP.18529/2019) pending disposal of the above AS.608/2019 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S A.V.B.KRISHNAKANTH, Advocate for the petitioner and of MR.R.UDAYA APRAKASH, Advocate for the Respondent the court made the following order:- The First Appeal was admitted and an interim stay was granted on condition to deposit the decree amount.

2. However, it is brought to the notice of this Court that the appellant in the First Appeal has not deposited the decree amount as per the condition imposed by this Court, while granting interim stay.

3. Thus, the Stay Petition filed in CMP.No.18529 of 2019 in AS.No.608 of 2019 stands dismissed.

4. Registry is directed to list the First Appeal for hearing in next week.
