O R D E R

The present criminal original petition has been filed seeking a direction to the respondents to register the petitioner's complaint dated 20.04.2015 and investigate the matter and file a final report in accordance with law.

2. In the petition, it has been stated that the petitioner is an absolute owner of 2172 sq.ft. vacant site and tiled house therein situated in the Block 14, Ward-B, No.3/1 at 10th street, New Betheleham, Ambur Town. Due to financial necessity, he executed a General Power of Attorney in favour of one Balaji Prasath to sell his property and the power agent sold the property to the tune of Rs.20,00,000/-. After selling the property, the said Balaji Prasath has paid only a sum of Rs.3,10,000/- to the petitioner and represented that the https://hcservices.ecourts.gov.in/hcservices/

remaining amount would be paid by him within a month. Till now, the said Balaji Prasath did not make any payment as agreed by him. Therefore, the petitioner has lodged the complaint on 20.04.2015. Since no action has been taken on the complaint lodged by the petitioner, he has come forward with the present petition.

3.Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that the matter is purely civil in nature and enquiry was conducted and the complaint was closed. He has also produced the closure report for the perusal of this Court.

4. In view of the same, since the complaint was already enquired and closed, nothing survives in this petition. Hence, the present criminal original petition is dismissed.
