O R D E R

The petitioner has come forward with this petition seeking for a direction to the learned District Munsif-cumJudicial Magistrate, Neyveli, to consider the petition to recall the non bailable warrant in S.T.C.No.205 of 2011 on the same day.

2.Learned counsel for the petitioner submits that the petitioner, who is the accused in S.T.C.No.205 of 2011 on the file of the learned District Munsif-cum-Judicial Magistrate, Neyveli, has preferred an appeal against the conviction and the same was taken on file. He further submits that since the petitioner has not appeared before the concerned Court, N.B.W. was ordered against him and the same has been pending. Therefore, he has come forward with this petition for the above stated relief. Now the matter has been settled between the petitioner and the respondent.

3.Today, both the petitioner and the respondent are present before this Court and represented that matter has been settled. The respondent herein has fairly conceded that he received the amount from the petitioner.

4.In view of the above submissions made by the petitioner as well as the respondent, the learned District Munsif-cum-Judicial Magistrate, Neyveli, is directed to accept the surrender of the petitioner and consider his application to recall N.B.W. on the very same, since the matter has been settled between the parties.

5.The Criminal Original Petition is disposed of with the above direction.
