.. Defendant Prayer: Plaint is filed under Order VII Rule 1 of the CPC Read With Section 7 of the Commercial Courts Act, 2015 Read With Order IV Rule 1 of the Original Side Rules, praying to grant a judgment and decree on the following terms:-
(a) To pay to the plaintiff the sum of Rs.1,41,84,279.70 together with interest at 24% p.a. on Rs.71,85,766/- from the date hereof till the date of realization in full.
(b) To pay the costs of suit;

JUDGMENT
The suit was instituted for a recovery of Rs.1,41,84,279.70 with further interest on the principal sum. Parties have reached a settlement and executed joint memo of compromise dated 29.12.2025. As per the said compromise, the defendant has paid the sum of Rs.32,50,000/- to the plaintiff by demand draft no.403900, dated 15.12.2025 and drawn on State Bank of India, Adyar branch, Chennai. In view thereof, the parties submit that the suit may be dismissed as settled out of Court.
2. Since parties have reached a out of Court settlement and provided evidence thereof, the suit is dismissed as settled out of Court and the court fee
