Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first and third respondents to consider the petitioner's representations dated 02.01.2020, 08.12.2021, 30.06.2022 and 05.09.2023 to count past service rendered from 29.01.1996 to 22.06.2004 for the purpose of promotion under career advancement scheme.

O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the first and third respondents to consider the petitioner's representations dated 02.01.2020, 08.12.2021, 30.06.2022 and 05.09.2023 to count past service rendered from 29.01.1996 to 22.06.2004 for the purpose of promotion under Career Advancement Scheme.

2. The learned counsel for the petitioner would submit that the petitioner has given the said representations to count his past service rendered from 29.01.1996 to 22.06.2004 for the purpose of promotion under 2/6

Career Advancement Scheme, and such representations are yet to be considered by the respondents. In this regard, the learned counsel for the petitioner relied upon the following judgements:- (i) S.Palanivel Vs. The Principal (W.P.No.10049, vide order dated 26.11.2009);

(ii) Dr.A.Annadurai Vs. The Government of Tamil Nadu (W.P.No.30292 of 2013, vide order dated 10.07.2017); (iii) Dr.Zubair. M Vs.The Universtiy of Calicut (W.P (C) No.7307 of 2016);

(iv) V.Kanagalatha Vs. The Government of Tamil Nadu (W.P.No.22127 of 2008, vide order dated 22.07.2021); (v) Dr.P.Gopinathn Vs. Tamil Nadu Physcial Education and Sports University (W.P.No.6352 of 2021, vide order dated 28.11.2023); and (vi) Dr.P.Manju Pushpa Vs. Bharathiar University (W.P.No.24015 of 2021).

3. At this juncture, the learned Government Advocate appearing for the first to third respondents would fairly submit that they would consider the said representations of the petitioner within a reasonable time. 3/6

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the first to third respondents and perused the materials available on record.

In such view of the matter, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representations dated 02.01.2020, 08.12.2021, 30.06.2022 and 05.09.2023, and pass orders on its own merits and accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. In the result, this Writ Petition is disposed of with the above observations. No costs.
