Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus to direct the respondents to allow the petitioner to participate in the third counseling for admission to MBBS course 2015-2016 based on merit and rank secured by the petitioner in the selection and consequently select and admit the petitioner in the MBBS Course in accordance with merit in the selection.

ORDER

When the writ petition is taken up for hearing, counter affidavit has been filed by the 1st and 2nd respondents herein, wherein it has been stated as under:

''7. It is submitted that the last candidate allotted to Government MBBS in B.C. Category whose general rank is 1542 and the cut off mark is 197.25. The seats in Government Medical Colleges were exhausted. Hence, the petitioner's option to be wait-listed for Government MBBS seat during the https://hcservices.ecourts.gov.in/hcservices/

1st phase of counselling is still maintained and his wit list number is 135.

8. It is submitted that during the 1st phase of counselling itself the petitioner has opted out for Self-Financing MBBS and Government BDS. Hence, the petitioner is eligible to participate in the third phase counselling and it is open to the petitioner that he can participate in the 3rd phase counselling which will be held during the second week of September 2015.

In view of the reasons stated above, it is prayed that this Hon'ble Court may be pleased to dismiss the writ petition as devoid of merits and thus render justice.''

2. In view of the same, learned counsel for the petitioner submits that nothing survives for adjudication in this writ petition.
