ORDER : The Court Made the following order :- The petitioner, who was arrested for the alleged offences under section 3(2)(c) and 14 of Foreigners Act, 1946, seeks bail. 2.The petitioner herein alleged to be a foreigner had entered into Indian Territory and fabricated documents like Aadhaar Card, Driving License, etc., and has obtained Indian Passport, as if he is an Indian nationality.
3.The petitioner is before this Court on the ground that he is in prison for more than 200 days. The petitioner has to prove that he is the Indian by birth.
4.This Court, on considering the material relied by the prosecution filed along with the final report, is of the view that the charge against the petitioner is in connection with the fabrication https://hcservices.ecourts.gov.in/hcservices/
documents to obtain Aadhaar Card, Driving License and Passport. The trial Court on perusing the documents relied by the prosecution has taken cognizance on the report and assigned S.C.No.196 of 2021, which is now ripe for trial.
5.Considering the said fact, this Court is of the view that there is no change of circumstances to revisit the earlier dismissal.
