Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus, directing the 1st respondent to dispose of Petitioner's implead Petition dated 10.04.2017 under Order I, Rule 10 & Section 151 of C.P.C in I.A.No.Un numbered of 2017 in O.A.No.29 of 2014 within the stipulated time.

O R D E R

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the first respondent to dispose of the petitioner's implead petition dated 10.04.2017 under Order I, Rule 10 & Section 151 of C.P.C in I.A.No.Nil of 2017 in O.A.No.29 of 2014, within a time frame.

2.The learned counsel appearing for the petitioner submitted that the first respondent has not numbered the impleading petition filed in O.A.No.29 of 2014, though the same was filed as early as on 10.04.2017.

3.Mr.M.Maharaja, learned Special Government Pleader, taking notice for the first respondent, submitted that the first respondent may be directed to number the application and dispose of the same in accordance with law, after giving notice to the respondents 2 to 8.

4. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the first respondent to number the impleading petition filed on 10.04.2017 in O.A.No.29 of 2014 , within one week from the date of receipt of a copy of this order and thereafter dispose of the same in accordance with law, after hearing the respondents 2 to 8.

5.With this observation, the Writ Petition is disposed of. No costs.
