O R D E R

The Writ Petition has been filed to direct the Respondents to consider the representation dated 08.02.2019 made by the Petitioner.

The Respondents have filed Counter Affidavit dated 29.04.2019 explaining the action taken on the aforesaid representation made by the Petitioner, which is extracted below:- "2.

It is submitted that the road NH45A (VillupuramPondy-Nagapattinam Road) is under the maintenance of Villupuram (NH) Sub-Division. In the following the work of "Widening of cement concrete pavement from km 0/035 - 1/230 including Widening and Strengthening of existing carriageway in km 0/0 - 0/035, reconstruction of storm water drain and construction of crash Barrier

type centre median and paved shoulders on NH45A and the work was entrusted to M/s. Arunai Constructions, Tiruvannamalai vide C.R. Agt. No. 2/2018-19 dt:09.04.2018. The nature of work is:

i. Widening of cement concrete road on either side of existing cement concrete road.

ii.Construction of storm water Drain on either sides of road.

iii.Construction of crash Barrier type centre median and iv.Providing paved shoulders.

I respectfully submitted that in connection to the above work, we arranged the co-ordination meeting with all line departments likely, Municipality, BSNL, TNEB, Revenue Departments, TWAD Board and Private Telecom, etc.,. on 28.06.2018 and 21.08.2018 in Villupuram Collectorate chamber for co-operation to execute the work. The it has been intimated to Municipality Department in detials vide Lr. No-02/2018/JD0/ dt:05.06.2018, stating that the work is going to start shortly, during the execution of work the Municipal utilities like water pipe lines, sewerage lines, may get damaged. Hence, the municipality department is requested to shift the water pipe lines and sewerage lines which are hindrance for the work.

I respectfully submitted that during the above said work the water pipe line got damaged and the same was duly instructed to the Villupuram Municipality Department. And they attended the pipeline damages and the same has been rectified immediately. And thereafter, the construction of storm water drain was started on 16.11.2018 and completed on 01.12.2018. Thereafter, the relief sought by the Petitioner is already been rectified by the municipality department. 5.

The cement concrete road was laid by using cement as per design mix which was obtained from "Highways Research Station" Guindy. In that it is mentioned that the type of materials for concrete mix as cement, Fine aggregate (crushed stone sand), coarse aggregate, water and mixture. In this connection, the petitioner misunderstood that the usage of crushed stone sand (which is part of material required for concrete instead of river Sand) as crusher powder."

Learned Counsel for the Petitioner accepts the same and he has made an endorsement to that effect, which is recorded. Nothing survives for further adjudication in the Writ Petition.
