Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 21.09.2021 with regard to wrong entry made by the second and third respondents to the respondents 4 to 17 herein bearing patta No.155 in respect of Survey No.193/2C measuring 0.5.50 Hectares and S.No.193/6C measuring 0.4.50 hectares situate at Arumbakkam Village, Arakkonam Taluk, Ranipet District and by including the name of the petitioner as owner of the property thereon by virtue of sale deed dated 20.07.1946 with document No.2602 of 1946, SRO Arakkonam. ORDER

Since no adverse Order has been passed as against the respondents 4 to 17, notice to him is dispensed with. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This Writ Petition is filed to direct the respondents to consider the representation of the petitioner dated 21.09.2021 with regard to wrong entry made by the second and third respondents to the respondents 4 to 17 herein bearing patta No.155 in respect of Survey No.193/2C measuring 0.5.50 2/5

Hectares and S.No.193/6C measuring 0.4.50 hectares situate at Arumbakkam Village, Arakkonam Taluk, Ranipet District and by including the name of the petitioner as owner of the property thereon by virtue of sale deed dated 20.07.1946 with document dNo.2602 of 1946, SRO Arakkonam.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.

4. The case of the petitioner is that the subject property has been purchased by the father of the petitioner by virtue of the registered sale deed dated 20.07.1946 and after the death of his father, the petitioner being the only son of his father, was in absolute possession and enjoyment of the property. While so, the respondents 4 to 17 by forging the documents obtained patta illegally and unlawfully from the third respondent. The grievance of the petitioner is that though he has made a representation to the second and third respondents to delete the name of the rival claimants, they have not taken any action in this regard. Hence, the present Writ Petition. 3/5

Considering the limited relief sought for in this writ petition, the respondents are directed to consider the representation of the petitioner dated 21.09.2021 and pass appropriate orders on the same on merits and in accordance with law, after giving notice to the petitioner and the respondents 4 to 17, within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
