C.M.P.No.10025 of 2024 in S.A.SR.No.3582 of 2024 N.MALA,J, M/s.V.Divia Bharathi, learned counsel takes notice for the sole respondent.

2. This petition has been filed to condone the delay of 93 days in filing the second appeal.

3. It is stated in the affidavit that the petitioner is a senior citizen aged about 75 years and due to ill heath, he was not able to contact his counsel.

4. Being satisfied with the reasons cited in the affidavit filed in support of this petition, the delay of 93 days in filing the second appeal is condoned.

5. Registry is directed to number the second appeal, if it is otherwise in order.

6.Accordingly,the civil miscellaneous petition is ordered.

7. Registry is directed to post the second appeal along with S.A.No.431 of 2024.
